A recent post by John Day (Day on Torts) has a nice recap of The Tennessee Department of Commerce and Insurance 2008 Medical Malpractice Claims Report. John's summary includes 4 years worth of data on jury verdicts, settlements, cases dismissed without payment and attorneys fees paid in med. mal. cases. Interesting stuff! What suprised me is that very few of the cases that went to trial resulted in plaintiff's verdicts. If I understand the numbers correctly, of the cases that went to trial in 2007, there were only 7 plaintiffs' verdicts and 306 defense verdicts.
