This year the legislature enacted the medical malpractice reform bill, which takes effect October 1, 2008. See my April 27, 2008 post for a summary of the changes and a link to the bill.
Among the changes is the requirement that plaintiffs in a medical malpractice case complete and file a “Certificate of Good Faith” with the court no later than 90 days after a case is commenced. Defendants are required to file a similar certification if comparative fault of a non-party provider is asserted as a defense to the action. The Tennessee Administrative Office of the Courts has developed form certificates of good faith in collaboration with the Tennessee Association for Justice and the Tennessee Medical Association.
